1. Identify the specific purpose and parties involved
Determine the exact transaction(s) you need your attorney-in-fact to handle (e.g., selling real estate, conducting business, or managing bank accounts) and gather all basic details, including principal’s and attorney-in-fact’s full names and addresses.
2. Draft the document
Prepare a written document clearly defining the scope of authority you’re granting. Include complete names, addresses, the exact powers (e.g., selling property with its title number), and any limits or conditions. Ensure you specify when the SPA takes effect and when it ends (if applicable).
3. Review and finalize the wording
Double-check for errors or ambiguity, especially regarding dates, property details, and authorized actions. Incorporate any special clauses you may need, such as financial limits or conditions for legal representation.
4. Prepare valid identification IDs
Gather government-issued IDs (e.g., passport, driver’s license) for both principal and attorney-in-fact. You’ll present these to the notary public for verification.
5. Execute the SPA before a Notary Public
